These Terms of Service ("Terms") govern your use of kitedakhla.com and any kitesurfing lessons, equipment rental, or related services (the "Services") provided by Daiokan SA, trading as Mirage Dakhla. By using our site or booking a service, you agree to these Terms.

2. Services we offer

Mirage Dakhla is a mobile kitesurfing school operating in Dakhla, Morocco. We offer:

• Private and semi-private kitesurfing lessons.
• Kite and equipment rental (with supervision as agreed).
• Desert and lagoon experiences, transport, and related activities.

The exact content of your booking is the one confirmed in writing (email or WhatsApp) between you and Mirage Dakhla.

3. Booking and payment

• Bookings are made through our booking form, by email, or via WhatsApp.
• A booking becomes binding once we have confirmed availability in writing and received any required deposit.
• Prices are in Euro (EUR) and include VAT where applicable.
• Payment terms, deposit amount, and accepted payment methods will be communicated in your booking confirmation.

4. Cancellations, changes, and refunds

• Cancellation by you: terms depend on the package and the notice given. Details are in your booking confirmation and will be shared before payment.
• Cancellation by us (for safety, weather, or operational reasons): you will be offered a rescheduling or a refund of the affected sessions, at our discretion.
• Weather & wind: lessons depend on wind and safety conditions. If conditions do not allow safe practice, your instructor will reschedule, adapt the session (e.g., theory, desert activity), or issue a credit. No refund is due for natural conditions once the service has started.
• No-shows: not refundable.

5. Safety, fitness, and your responsibilities

Kitesurfing is a physical sport that carries inherent risks. By booking you confirm that:

• You are in good health and physically fit enough to participate, or have informed us in writing of any relevant medical condition.
• You can swim.
• You will follow the instructions of your instructor and any safety briefing at all times.
• You are responsible for your personal belongings and for any damage caused by negligence or misuse of equipment.
• Minors must be accompanied and authorised by a parent or legal guardian.

Mirage Dakhla reserves the right to stop a lesson or refuse service if a participant's behaviour puts themselves or others at risk.

6. Equipment

• We provide kitesurfing equipment in good working condition for the lesson or rental period.
• You are responsible for treating the equipment with care. In case of damage or loss caused by negligence or misuse, you will be asked to contribute to repair or replacement, up to the value of the equipment, unless covered by the optional gear insurance.
• Optional gear insurance is available and its terms will be shared on request.

7. Insurance

Mirage Dakhla holds professional liability insurance for its instructors and activities. Participants are strongly recommended to have their own travel and accident insurance covering kitesurfing and water sports. Mirage Dakhla cannot be held responsible for personal injuries or losses that are not attributable to our fault.

8. Intellectual property

All content on kitedakhla.com — text, images, video, logo, and design — is owned by Daiokan SA or its licensors and protected by copyright. You may view and share the content for personal, non-commercial use. Any other use requires our prior written consent.

9. Photos and videos taken during lessons

We may take photos or videos during sessions for internal quality purposes and, with your consent, for marketing on our website and social channels. If you do not wish to appear, tell your instructor or email support@kitedakhla.com and we will respect your choice.

10. Liability

To the maximum extent permitted by Belgian law:

• Mirage Dakhla's total liability for any claim arising from the Services is limited to the amount actually paid by you for the affected booking.
• We are not liable for indirect or consequential damages such as loss of holiday enjoyment, travel costs not purchased through us, missed flights, or loss of earnings.
• Nothing in these Terms excludes liability that cannot be excluded by law (e.g., for fraud, gross negligence, or personal injury caused by our fault).

11. Force majeure

We are not liable for failure or delay in performing the Services when caused by circumstances beyond our reasonable control — including extreme weather, natural disaster, illness, government action, border closures, or travel restrictions. In such cases we will work with you to reschedule or offer a fair alternative.

12. Privacy

Our collection and use of your personal data is governed by our Privacy Policy.

13. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the current version. The version in force on the day of your booking applies to that booking.

14. Governing law and jurisdiction

These Terms are governed by Belgian law. Any dispute will be submitted to the competent courts of Brussels, Belgium, without prejudice to any mandatory consumer-protection rules in your country of residence.

These Terms are provided for informational purposes and reflect standard industry practice for a Belgian adventure-sports business. For bookings with unusual risk or high-value packages, we recommend a signed waiver in addition to these Terms. Daiokan SA may adapt specific clauses in writing with individual customers.
